Our services are available to law firms and licensed legal professionals in the United States. By using BTM Intake, you represent that:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
BTM Intake sends automated SMS messages on behalf of law firm clients. By using our SMS features, you (as the law firm client) agree to:
BTM Intake reserves the right to suspend or terminate SMS services for any account found to be in violation of these terms or applicable law without prior notice.
You agree not to use BTM Intake to:
BTM Intake services are billed on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are stated in US dollars.
All content, software, designs, and materials on btmintake.com and within our platform are the property of BTM Intake and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
You retain ownership of all data, content, and information you provide to us. By using our services, you grant BTM Intake a limited license to use your data solely to provide and improve our services.
BTM Intake treats all law firm data, client information, and lead data as confidential. We will not disclose your firm's information or your clients' information to third parties except as described in our Privacy Policy or as required by law.
You agree to keep any non-public information about our platform, pricing, and technology confidential.
BTM Intake provides its services on an "as is" and "as available" basis. We do not warrant that our services will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
BTM Intake is not a law firm and does not provide legal advice. We are a technology platform. Nothing in our services constitutes legal advice, and use of our platform does not create an attorney-client relationship between BTM Intake and any end user.
To the maximum extent permitted by applicable law, BTM Intake and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total fees paid by you in the three months preceding the claim.
You agree to indemnify, defend, and hold harmless BTM Intake and its founders, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any applicable law or third-party right.
Either party may terminate the service relationship at any time. BTM Intake may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or use our services in a way that could expose us to legal liability.
Upon termination, your right to access our platform ceases immediately. We will provide you with a data export upon request within 30 days of termination.
These Terms are governed by and construed in accordance with the laws of the United States and the state in which BTM Intake is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
